To potentially be included in this list, a company must have been (i) founded in or before 2020, (ii) have at least $250,000 in revenue in 2020 and (iii) earned revenue in 2020, 2021 and 2022. The participating company must report revenue for all three years and upload one form of revenue verification (found on the Media Requirements page). All entries must either: (1) include a signed statement by either the agency’s CFO or CEO attesting to the accuracy and trust of the reported revenue figures and/or (2) include an audit financial statement from a recognized CPA firm.
To be one of Adweek’s Fastest Growing, a participant must have met all eligibility requirements of the promotion, including without limitation the execution of required waivers, publicity and liability releases and disclaimers.
By submitting an entry to Adweek’s Fastest Growing, the participating company represents and warrants that the information and materials submitted are accurate. Adweek reserves the right to audit submissions for accuracy and to reject any submission, at Adweek’s sole and absolute discretion (no refund of any submission fees will be made).
Entries submitted become the property of Adweek and cannot be returned. Each participant, by clicking the box to enter the promotion, grants a non-exclusive, perpetual, irrevocable, worldwide, transferable, royalty-free, paid up right to Adweek to reproduce, perform and display the entries (including, without limitation, in edited form or as part of compilations of entries) at Adweek’s Fastest Growing Awards event (if any), on Adweek's website and social media pages, and otherwise for educational and editorial purposes and for marketing and promoting Adweek’s Fastest Growing Awards on any platform in any media now or hereafter known.
Each participant represents and warrants that it has the right to enter into this promotion. The person submitting this entry form(s) on behalf of the agency represents and warrants that he or she has full authority to enter this promotion, submit the entry media and grants the rights granted herein. This entry form constitutes the entire agreement of the parties and the participant warrants and represents that he or she has not relied on any promise or statement not expressly set forth herein.
Adweek, depending on the entries received, and exercising its editorial judgment in its sole and exclusive discretion, will determine which companies will be recognized as Adweek’s Fastest Growing. Adweek will be the sole judge of which agencies are recognized and its decisions will be final, binding and conclusive. There will be no prizes.
Those companies who are recognized as one of Adweek’s Fastest Growing may receive a certificate or other form of recognition which they can publicly share subject to certain stylistic guidelines which will be provided to the agencies.
CONSENT AND RELEASE
By entering Adweek’s Fastest Growing, each participant releases and discharges Adweek, judges, and any other party associated with the development or administration of this list, their parent, subsidiary, and affiliated entities, and each of their respective officers, directors, members, shareholders, employees, independent contractors, agents, representatives, successors and assigns (collectively, 'Released Entities'), from any and all liability whatsoever in connection with this promotion, including without limitation legal claims, costs, injuries, losses or damages, demands or actions of any kind (including without limitation personal injuries, death, damage to, loss or destruction or property, rights of publicity or privacy, defamation, or portrayal in a false light) (collectively, 'Claims').
By submitting an entry, a company agrees to the following:
(i) to be bound by these Rules.
(ii) that Adweek (and/or others authorized by Adweek) may use the name and likeness of such company for editorial, advertising and publicity purposes without further compensation;
(iii) a complete release by company of the Released Entities of any and all Claims in connection with the administration of this promotion;
(iv) an agreement to sign an affidavit of eligibility (including EIN or social security number) and a liability/publicity release; and
(v) an agreement that Adweek may provide Company’s name and email address to third parties partnering with Adweek in the promotion so that participant may be contacted by such third party.
Note: Affidavits and releases must be returned within seven (7) days from the date that Adweek first tries to notify the potential recipient.
(i) Entries that are lost, late, misdirected, incorrect, garbled, or incompletely received, for any reason, including by reason of hardware, software, browser, or network failure, malfunction, congestion, or incompatibility at Adweek's servers or elsewhere, will not be eligible. In the event of a dispute, entries will be deemed submitted by the authorized account holder of the e-mail address submitted at the time of entry. 'Authorized account holder' is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
(ii) Adweek, in its sole discretion, reserves the right to disqualify any agency, participant, person or company tampering with the entry process or the operation of the web site. Use of bots or other automated process to enter is prohibited and may result in disqualification at the sole discretion of Adweek.
(iii) Adweek further reserves the right to cancel, terminate or modify the promotion if it is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, force majeure or technical failures of any sort.
(iv) The Released Entities are not responsible for errors in the administration or fulfillment of this promotion, including without limitation mechanical, human, printing, distribution or production errors, and may modify or cancel this promotion based upon such error at its sole discretion without liability.
(v) RELEASED ENTITIES MAKE NO WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, AS REGARDS THIS CONTEST.
(vi) CAUTION: ANY ATTEMPT BY AN PARTICIPANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, ADWEEK RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING WITHOUT LIMITATION ATTORNEYS' FEES) FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
APPLICABLE LAWS AND JURISDICTION
THE CONTEST IS GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF NEW YORK, AND THE FORUM AND VENUE FOR ANY DISPUTE SHALL BE IN NEW YORK COUNTY, NEW YORK. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY AMERICAN ARBITRATION ASSOCIATION, IN ACCORDANCE WITH ITS ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“AAA RULES”). THE AAA RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN THE STATE OF NEW YORK. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES (WHICH DAMAGES WILL NOT EXCEED THE AGENCY’S ENTRY FEE), AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEYS’ FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF. PARTICIPANTS AGREE THAT THE STATUTE OF LIMITATIONS FOR ASSERTING ANY CLAIMS SHALL BE A PERIOD OF ONE (1) YEAR FROM THE END OF THIS CONTEST. PARTICIPANTS AGREE THAT ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
